USCIS Application Guidelines:
Veterans can petition for visas for their family members, particularly spouses and children, through various channels including family-based petitions and special immigration benefits. This process generally involves submitting Form I-130 (Petition for Alien Relative) and may include Form I-485 (Application to Adjust Status) if the family member is already in the U.S.

Process Overview:

  1. Filing Form I-130 (Petition for Alien Relative):
    The veteran, as a U.S. citizen or lawful permanent resident, files Form I-130 to establish the qualifying family relationship. This petition is submitted to the U.S. Citizenship and Immigration Services (USCIS).
  2. Consular Processing or Adjustment of Status:
    If the family member resides outside the U.S., they apply for an immigrant visa through consular processing at a U.S. embassy or consulate in their home country.
    If the family member is already in the U.S., they may apply to adjust their status to lawful permanent resident using Form I-485.
  3. Additional Military Family Considerations:
    Parole in Place (PIP):
    For family members who entered the U.S. without authorization, PIP may allow them to remain legally and apply for a green card without leaving the country.
    Discretionary Relief: USCIS may grant discretionary relief for urgent humanitarian reasons or significant public benefit related to military families.
    Surviving Spouses and Children: Family members of service members who die due to combat-related injuries may be eligible for survivor benefits, including expedited citizenship.
  4. Required Documentation:
    Proof of qualifying family relationship (e.g., marriage or birth certificates).
    Evidence of military status (e.g., DD Form 214, military ID).
    Additional documents as requested by USCIS.
  5. Green Card Application:
    After Form I-130 approval and eligibility confirmation, the family member can apply for lawful permanent residence. This process typically includes a biometrics appointment for fingerprinting and background checks.
